Rules

These Rules and Regulations are intended to ensure that all Members can enjoy the use of our Services. Repeated breaches of these Rules or any conduct which we believe to be detrimental to our community may result in the termination of your membership without prior notice in our sole and absolute discretion:

1. Membership

Our services are available to members who are above the age of 21. You agree to provide us with accurate and complete information about yourself when you register with us and as you use our services. You also agree to keep your information up to date. Don’t reveal your account password to anyone else or let them use your account. You are responsible for maintaining the confidentiality of your password. You should promptly notify us if you suspect your password has been compromised. 

2. Incorporation of DropSpot FAQ’S, DropDesk Terms Of Service and Privacy Policy; Updates

We maintain other terms and policies that supplement these Rules and Regulations like our DropDesk/DropSpot Terms of Service and  Privacy Policy, which describes our collection and use of personal data. You agree that your use of the DropDesk Platform and Host Services or other services provided directly by us (“DropSpot Services”) constitute your  acceptance of these Rules and Regulations, our DropDesk/DropSpot Terms of Service and  Privacy Policy,. We expressly reserve the right to change our Terms and these Rules at any time for whatever reason whatsoever, including, but not limited to, changing our business model and adding or changing any Membership or use fees. When we make changes we will post the revised terms on our website and update the “Last Updated” date at the top of these Rules. You agree that you will immediately stop using your Account, our Platform and Services if at any time you do not agree with these Terms or any modifications thereof. You agree that your continued use of the DropSpot Services subsequent to any modifications will constitute an acceptance of the Terms as so changed. 

Guests/Users

3. Use of Spaces 

In general, we expect that you will not perform any activity that is reasonably likely to be disruptive, damaging or dangerous to other Members, their guests or the property of the foregoing. This includes anything your family would disapprove of! It goes without saying that we expect you to comply with all laws and local ordinances and as a User any special conditions that a Host may include in the Package that you booked. 

4. Overstaying your Booking – Faliure to move your vehicle.

It is important that you move your vehicle prior to the allotted time expiring as referenced in your Package unless you are able to purchase another Package to extend your departure time. Failure to move your vehicle obviously prevents others from using the Space who may have booked a Package. In order to incentivize a great User experience for a everyone we will provide a 5 minute window after which you will be charged a pro-rated amount for each 15 minutes you overstay at a rate equal to 1.5x your Booked Rate. You will be notified through the App if you overstay and you have the ability to communicate with your Host through the App by clicking the message icon if a problem has arisen. If you take no action the Host reserves the right to have your car towed by a licensed towing operator at your cost and expense. Obviously no one wants to see this scenario occur so please pay attention to your Booking Details and any Special instructions which you can see in the Booking email and in the Booking activity screen which can also be accessed by clicking the deep link in the text confirmation you will have received. You expressly agree by using the DropSpot Service that in a worst case scenario your vehicle may be towed. Prior to that happening you will be notified through the App with details on how to contact the towing company to retrieve your vehicle.

Hosts

5. Did The Right Person Park In My Space?

DropSpot sends directions to the customer to share their license plate and car model. In the event they do not, you can simply click the message customer button under a booking to confirm the reservation and request their license plate and car model.

6. Host Standards

DropSpot’s standards for Hosts are simple and tied to how you would want to be treated. If you cannot maintain the Host standards, then we will remove your listing from our website. 

  1. Create a safe space: we require all spots to be private – owned or controlled by the host (e.g. no public parks or shared spaces in apartment complexes, etc.). We require all Space to be free of animals and children during guest visits. 
  2. Accurately and completely represent yourself and your Space: we require each listed Space to have at least 1 photo of the Spaces. Spend a minute thinking through your Space to make sure that your Users don’t have any negative surprises when they show up at your Spaces. If you get a question from a guest about your Space, take a moment to update your listing with the answer.
  3. Accommodate bookings: it is expected that you are keeping your calendar up to date and that when a guest books your Space you will accommodate that booking.
  4. Be responsive: if someone sends you a message or a reservation, get back to them as quickly as you can. As a guest, there is nothing better than getting a super-fast response. All messaging should be done through the DropSpot messaging tools. Asking people to text or call you directly is confusing to our guests; it’s simpler for users to message through DropSpot.
  5. Get good reviews: this goes without saying. In the end, if you have great reviews from your Guests, you are doing it right!
  6. DropSpot Inclusion:  We are an inclusive community and do not tolerate discrimination. 
  7. Reservations: Our system only allows one booking at a time, so there can be no other users there at the same time as your guest. Ideally use a 30 minute buffer between each Booking. 
  8. Overstays: In the unlikely event that a guest overstays their booking and has not extended their Booking, contact Help Center >. Our Member User terms allow for a car to be towed in a worst case scenario.

7. DropSpot Fees; Timing of Commission Payments

There is no flat charge to host with DropSpot. DropSpot charges a commission on each booking or subscription to cover our costs. The total Commission cost to hosts is 30% inclusive of all payment processing fees to collect payment and provide monthly payouts, unless we have agreed alternative arrangements in a writing signed by us. Payments will be made to Hosts net of the Commission, refunds or charge backs monthly on the 15t​h​ day of the following month in which payments for Bookings were received. We will provide a monthly statement along with the payment of the Commission.
